1. Acceptance of these Terms
By creating an account or using JBayLet, you confirm that you have read, understood, and agree to these Terms of Service, the Legal & Compliance page, the Refund and Cancellation Policy, the Subscription Terms where applicable, and any listing rules or policies shown during use of the platform.
If you use JBayLet on behalf of a business, property owner, host, or agency, you confirm that you are authorised to act for that party and to bind that party to these terms.
2. Account Registration and Verification
- You must provide accurate registration information and keep your account details up to date.
- You are responsible for protecting your password, email account, verification links, and any activity that happens under your account.
- You may not create accounts using false details, another person’s identity, misleading contact information, or information you are not authorised to use.
- JBayLet may ask for additional information where needed for safety, support, compliance, fraud prevention, payment partner requirements, agency review, or legal obligations.
3. JBayLet’s Platform Role
JBayLet provides a property listing, discovery, enquiry, booking-request, dashboard, messaging, review, and subscription access platform. JBayLet is not the owner, landlord, estate agency, letting agency, accommodation provider, payment intermediary, escrow service, or merchant of record for guest-to-host booking payments.
Guests, tenants, students, buyers, hosts, property owners, and agencies are responsible for the agreements they make with each other, including pricing, deposits, inspections, lease terms, booking terms, payment methods, commissions, cancellation terms, refunds, handover arrangements, and legal compliance.
4. Listings and Host Responsibilities
- Listings must be accurate, lawful, current, and not misleading.
- Hosts and agencies must have the right to list, market, rent, sell, manage, or represent the property they publish.
- Photos, prices, availability, amenities, rules, location details, safety information, cancellation terms, and fees must be stated honestly.
- Hosts and agencies must comply with applicable South African laws, municipal rules, building rules, body corporate rules, rental housing requirements, property practitioner obligations, consumer protection rules, and any other laws that apply to their listing or business.
5. Payments, Bookings, and Direct Agreements
Paystack is used by JBayLet for service provider subscriptions only. Guest booking payments are discussed and handled directly between the guest and the host or agency. JBayLet does not collect, hold, split, reverse, or pay out guest booking funds.
Before paying a host or agency directly, users should confirm the property, dates, amount, deposit, refund terms, bank or payment details, proof of authority, and written cancellation terms. Users should keep records of all payment instructions, receipts, invoices, messages, and agreements.
6. Prohibited Conduct
- Do not commit fraud, impersonation, harassment, discrimination, spam, phishing, unlawful marketing, or abusive communication.
- Do not upload malware, attempt unauthorised access, scrape the platform unlawfully, bypass access controls, or interfere with site security.
- Do not publish illegal, unsafe, discriminatory, deceptive, defamatory, private, infringing, or harmful content.
- Do not ask users to use unsafe payment methods, hide material fees, misrepresent availability, or pressure users into payments outside a clear written agreement.
7. Reviews and Public Content
Reviews must reflect genuine experiences and must not be fake, paid, retaliatory, abusive, defamatory, discriminatory, or used to reveal private information. JBayLet may remove or restrict reviews that breach these terms or applicable law.
By submitting content to JBayLet, you confirm that you have the right to submit it and you allow JBayLet to display, moderate, store, and use it as needed to operate the platform.
8. Enforcement, Suspension, and Changes
JBayLet may reject listings, restrict features, pause listings, suspend accounts, remove content, place accounts under review, request additional information, or report serious matters to relevant authorities where we identify fraud, safety risk, illegal activity, non-compliance, misleading information, payment abuse, or breach of these terms.
JBayLet may update these terms when the platform, legal requirements, payment partner requirements, or operating processes change. Continued use after an update means you accept the updated terms.
